By installing, accessing, or using our applications or website (https://mtnstormdaq.com), you agree to be bound by these Terms.

1. Software Usage License

MOUNTAIN STORM INSTRUMENTS LLC grants you a non-exclusive, non-transferable, revocable license to download and use our applications for personal or internal professional purposes strictly in accordance with these Terms and Google Play Store Terms of Service.

2. Navigation & Field Use Disclaimer (GPS Applications)

  • Informational Tool Only: Navigation, mapping, and GPS features provided in our applications are intended strictly as secondary navigational aids. They are NOT intended to replace primary navigation equipment, certified aviation instruments, nautical charts, or standard safety survival gear.
  • User Responsibility: You assume full responsibility for verifying position accuracy, route safety, and terrain hazards. Always maintain environmental awareness during field operations.

3. Acoustic & Telemetry Measurement Disclaimer (Audio Applications)

  • Non-Certified Measurements: Audio spectrum, volume level, and signal processing metrics are derived from consumer mobile device hardware. They are provided for reference and educational purposes only and are NOT certified for occupational safety enforcement, legal compliance sound level surveys, or medical diagnostics.

4. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR APPLICATIONS AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

5. Limitation of Liability

IN NO EVENT SHALL MOUNTAIN STORM INSTRUMENTS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PHYSICAL INJURY, PROPERTY DAMAGE, EQUIPMENT FAILURE, OR BUSINESS INTERRUPTION—ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE OUR SOFTWARE.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in New Mexico.
